It is very important that as soon as possible after separation you and your former spouse finalise property and financial matters in the form of a Consent or Court Order or Binding Financial Agreement.

Same-Sex Relationships:

Same-sex couples now have the same rights as heterosexual married or de facto couples in relation to property settlements and parenting matters.

We understand that same-sex and trans families have discrete experiences that require specialised knowledge, such as parenting matters, surrogacy, adoption or IVF processes.

Surrogacy & IVF:

Surrogacy in New South Wales is regulated by the Surrogacy Act 2010. If you are an intended parent living in New South Wales, then the surrogacy laws that apply to you are those of New South Wales.

All women in New South Wales can access IVF treatment regardless of whether they are single or partnered. The Assisted Reproductive Technology Act 2007 allows donors of sperm or eggs to nominate classes of people who may not use their sperm or eggs. Since 2008, the female partners of women who conceive through IVF have been recognised as legal parents.

Child Support Matters:

After separation, parents can reach agreement about the financial support they pay to their child/ren, however regardless of circumstances each parent is responsible for the financial support of their child. Parents can reach an informal agreement as to how much financial support is needed for the child/ren.

Alternatively, parents and non-parent carers can make an application through Services Australia to decide how to manage, receive and pay child support.

Collaborative Practice:

Collaborative Practice is an alternative process where the parties are in control of their separation. Negotiations are open, honest and transparent. The parties sign a contract agreeing they will not go to Court. The solicitors guide the parties with the support of other experts to reach a resolution.

It is important for you to know that what your options are, to ensure the safety of you and/or your child/ren. At Byron Family Law we aim to approach all matters with a focus on trauma-informed practices, and prioritise our clients safety when navigating the legal system.
